Terms of Service

These Terms of Service ("Terms") govern your access to and use of the amarAI website, applications, and related services (together, the "Service") operated by Creative Collective LLC ("the Company", "We", "Us", or "Our"). Please read these Terms carefully before using the Service.

1. Acceptance of These Terms

By creating an account, subscribing to a plan, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, you may not use the Service.

2. Definitions

Account
means the registered account that allows you to access and use the Service.
Service
refers to amarAI — an AI-assisted customer messaging and automation platform for Facebook Messenger, Instagram Direct, and related channels, accessible from https://amarai.mn and https://app.amarai.mn.
Subscription
means a paid plan that grants access to the Service for a recurring period.
Customer Content
means any data, messages, contacts, or materials that you or your end customers submit to, or that are processed through, the Service.
You
means the individual or entity accessing or using the Service.

3. Eligibility and Accounts

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an Account and purchase a Subscription. You agree to provide accurate and complete registration information and to keep it up to date.

You are responsible for safeguarding your login credentials and for all activity that occurs under your Account. Notify us immediately at hi@amarai.mn if you suspect any unauthorized use of your Account.

4. Subscriptions, Free Trial, and Payments

  • Free trial. We may offer a free trial period (for example, 14 days). Unless you cancel before the trial ends, your Subscription may convert to a paid plan at the then-current price.
  • Billing. Paid Subscriptions are billed in advance on a recurring basis through our payment provider (including QPay for Mongolian customers). By subscribing, you authorize us to charge the applicable fees for each billing period.
  • Renewals and cancellation. Subscriptions renew automatically until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
  • Price changes. We may change our fees from time to time. We will give reasonable advance notice of any price change, which will apply from your next renewal.
  • Taxes and refunds. Fees are exclusive of applicable taxes. Except where required by law, payments are non-refundable.

5. Acceptable Use

When using the Service, you agree that you will not:

  • use the Service for any unlawful, fraudulent, or deceptive purpose;
  • send spam, unsolicited bulk messages, or content that violates the policies of Meta (Facebook and Instagram), QPay, or any other connected platform;
  • upload or transmit malware, or attempt to gain unauthorized access to the Service, other accounts, or our systems;
  • reverse engineer, scrape, resell, or build a competing product using the Service, except as permitted by law;
  • use the Service to violate the privacy or rights of others, or to process data you have no lawful basis to process.

You are responsible for complying with the terms and policies of any third-party platform you connect to the Service, including the Meta Platform Terms and Developer Policies.

6. Your Content and Data

You retain all rights to your Customer Content. You grant us a limited, worldwide, non-exclusive license to host, process, and transmit Customer Content solely to provide and improve the Service for you. You are responsible for ensuring you have the necessary rights and consents to submit Customer Content and to allow us to process it.

Our handling of personal data is described in our Privacy Policy. You or your end users may request deletion of personal data at any time — see our Data Deletion page.

7. AI-Generated Responses

The Service uses third-party AI models (such as those provided by Anthropic and Google) to generate suggested or automated replies. AI-generated output may be inaccurate, incomplete, or inappropriate for a given situation. You are responsible for reviewing and approving how the Service communicates with your customers, and we do not warrant that AI-generated content will be error-free or fit for any particular purpose.

8. Third-Party Services and Platforms

The Service integrates with third-party platforms and services, including Meta (Facebook Messenger and Instagram Direct), QPay, and AI model providers. Your use of those services is subject to their own terms and policies, and we are not responsible for their availability, content, or actions. We may add, change, or remove integrations at any time.

9. Intellectual Property

The Service, including its software, design, and content (excluding Customer Content), is owned by the Company and its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Service during your Subscription. All rights not expressly granted are reserved.

10. Service Availability and Changes

We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted or error-free. We may modify, suspend, or discontinue features of the Service, and we may offer beta or experimental features that are provided "as is" and may change or be withdrawn at any time.

11. Suspension and Termination

You may stop using the Service and close your Account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or use the Service in a way that may cause harm to us, other users, or third parties. Upon termination, your right to use the Service ends, and we may delete Customer Content in accordance with our Privacy Policy and applicable law.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

13. Limitation of Liability

To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless the Company and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your Customer Content, your use of the Service, or your breach of these Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of Mongolia, without regard to its conflict-of-law principles. You agree that the courts located in Ulaanbaatar, Mongolia will have jurisdiction to resolve any dispute arising out of or relating to these Terms or the Service, except where applicable law provides otherwise.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or through the Service. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
